Peran Mahkamah Konstitusi dalam Menjaga Hak Konstitusional Warga Negara sebagai Pilar Negara Hukum di Indonesia

Abstract

The establishment of the Constitutional Court is one of the outcomes of constitutional reforms aimed at strengthening the implementation of the rule of law in Indonesia. As an institution entrusted with the authority to safeguard the Constitution, the Constitutional Court plays a crucial role in ensuring that statutory regulations are consistent with the 1945 Constitution of the Republic of Indonesia and do not violate the constitutional rights of citizens. This study aims to examine the position of the Constitutional Court within the Indonesian constitutional system and analyze its role in protecting citizens’ constitutional rights. The research employs a normative legal method using statutory and conceptual approaches. The data were collected through a literature review of relevant legislation, legal textbooks, scientific journals, and Constitutional Court decisions. The findings indicate that the Constitutional Court holds a strategic position as a judicial authority and the guardian of the Constitution. Through its authority to conduct judicial review of laws against the 1945 Constitution, the Constitutional Court contributes to upholding constitutional supremacy, ensuring legal certainty, and protecting the constitutional rights of citizens.
