Maqasid Al-Shariah Sebagai Fondasi Reformasi Hukum Bisnis Islam: Dari Kepatuhan Formal Menuju Keadilan Ekonomi Substantif Di Kota Parepare

Abstract

This study aims to analyze the role of maqasid al-shariah as the foundation for the reform of Islamic business law in realizing a transformation from formal compliance toward substantive economic justice in Parepare. In the practice of the Islamic economy, the implementation of Islamic business law is often still oriented toward legal-formal and symbolic aspects, so that it has not fully succeeded in promoting social justice, economic equity, and comprehensive public welfare. Therefore, the maqasid al-shariah approach becomes essential as a normative framework that places public benefit (maslahah), protection of rights, and economic balance as the primary objectives of Islamic business and financial activities. This study employs a qualitative method with a normative-empirical approach. Data were collected through literature studies, observations, and interviews with sharia business actors, academics, and Islamic economic practitioners in Parepare. The analysis was conducted by examining the application of maqasid al-shariah principles in Islamic business law practices, particularly in terms of distributive justice, transaction transparency, consumer protection, and socio-economic responsibility. The findings reveal that the implementation of maqasid al-shariah can serve as an instrument for reforming Islamic business law in a more contextual and responsive manner to the needs of modern society. This approach not only emphasizes compliance with sharia contracts and procedures, but also prioritizes the realization of substantive economic justice through the strengthening of business ethics, equitable welfare distribution, protection of vulnerable groups, and the reduction of exploitative practices in economic activities. Furthermore, this study finds that the transformation of the Islamic business law paradigm based on maqasid al-shariah in Parepare has significant potential to support inclusive, sustainable, and public welfare-oriented regional economic development. Thus, maqasid al-shariah functions not only as a theoretical foundation in Islamic business law, but also as a reform paradigm capable of bridging formal sharia compliance with the achievement of substantive economic justice in contemporary society.
